TERMS OF SERVICE

Welcome to Enhancers ("the App"), a dietary supplement tracking application developed and operated by Airbag Studio Srl ("we," "us," "our," or "Company"). These Terms of Service ("Terms") govern your use of our iOS application and related services.

By downloading, installing, or using Enhancers, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

By accessing or using Enhancers, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Airbag Studio Srl.

By using the App, you represent and warrant that:

• You are at least 13 years of age
• If you are under 18, you have obtained parental or guardian consent to use the App
• You have the legal capacity to enter into these Terms
• Your use of the App does not violate any applicable law or regulation

Parents or guardians who allow minors between 13-18 to use the App are responsible for the minor's use and agree to be bound by these Terms on their behalf.

Enhancers is an iOS application that provides:

• Supplement Tracking: Comprehensive management of dietary supplements
• Intelligent Scheduling: Smart reminders and scheduling features
• Widget Integration: Real-time iOS widget support
• Interactive Notifications: Timely reminders for supplement intake
• AI-Powered Information: AI-generated informational content about supplements
• iCloud Sync: Data synchronization across your Apple devices
• Personal Notes: Ability to add personal notes to your supplement records

The App is built with SwiftUI, SwiftData, and CloudKit technologies to ensure a seamless experience across your Apple devices.

Payment Processing:

• All payments are processed through Apple's App Store
• Payment will be charged to your iTunes Account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

Managing Subscriptions:

• You can manage or cancel your subscription through your App Store account settings
• Go to Settings > [Your Name] > Subscriptions on your iOS device
• Cancellation will take effect at the end of the current billing period

To request a refund:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Select the subscription and follow Apple's refund request process

Apple will review your request and determine if a refund is appropriate according to their policies.

Data Storage and Synchronization:

• Enhancers does not require account creation
• Your supplement data is stored locally on your device
• Data synchronization across your devices is handled through Apple's iCloud/CloudKit
• You maintain control of your data through your iCloud settings

Data Responsibility:

• You are responsible for maintaining the security of your Apple ID
• We recommend regular iCloud backups to prevent data loss
• We are not responsible for data loss due to iCloud sync issues or device problems

Nature of AI Content:

• The App includes AI-generated informational content about supplements
• This content is for informational purposes only
• AI-generated content may contain errors or inaccuracies
• Always verify important information with reliable sources

Limitations:

• AI does not provide personalized medical recommendations
• AI content should not influence medical decisions
• We do not guarantee the accuracy or completeness of AI-generated information

Personal Notes:

• You can add personal notes to your supplement records
• These notes are private and not shared with other users
• You retain ownership of your personal notes
• Notes are synced via iCloud if enabled

Content Restrictions:

You agree not to include in your notes:

• Illegal or harmful content
• Personal information of others without consent
• Content that violates any applicable laws

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or hack the App
• Remove or alter any proprietary notices from the App
• Use the App to harm minors in any way
• Transmit viruses or malicious code
• Interfere with or disrupt the App's functionality
• Use automated systems or software to extract data from the App
• Violate any applicable laws or regulations
• Share subscription credentials with others

Ownership:

• Airbag Studio Srl owns all rights, title, and interest in the Enhancers app
• This includes the design, functionality, code, and user interface
• The Enhancers name and logo are trademarks of Airbag Studio Srl

License Grant:

• We grant you a limited, non-exclusive, non-transferable license to use the App
• This license is for personal, non-commercial use only
• The license is valid only while you maintain an active subscription

Restrictions:

You may not:

• Copy, modify, or create derivative works of the App
• Sell, rent, lease, or sublicense the App
• Use our trademarks without written permission

Your use of Enhancers is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

We disclaim all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• That the App will be uninterrupted or error-free
• That defects will be corrected
• That the App is free of viruses or harmful components

Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the subscription in the past 12 months
• We are not liable for any health outcomes resulting from use of the App
• We are not responsible for data loss or iCloud sync issues

You agree to indemnify, defend, and hold harmless Airbag Studio Srl, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws
• Any content you create or share through the App
• Any health decisions made based on the App's content

Termination by You:

• You may terminate these Terms at any time by deleting the App and cancelling your subscription
• Cancellation takes effect at the end of the current billing period

Termination by Us:

We may terminate or suspend your access immediately, without prior notice, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the App
• Your conduct may harm other users or us

Effects of Termination:

• Upon termination, your right to use the App ceases immediately
• We are not obligated to maintain or provide your data after termination
• All provisions that should survive termination will remain in effect

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Effective Date" at the top of these Terms
• We may notify you through the App or via email
• Continued use after changes constitutes acceptance of the new Terms
• If you disagree with changes, you should stop using the App and cancel your subscription

These Terms shall be governed by and construed in accordance with the laws of Italy and the European Union, without regard to conflict of law principles.

Dispute Resolution:

• Any disputes shall first be resolved through good faith negotiations
• If negotiations fail, disputes shall be submitted to the courts of Ascoli Piceno, Italy
• EU consumers may also use the EU Online Dispute Resolution platform

Additional Provisions:

• Severability: If any provision is found invalid, other provisions remain in effect
• Entire Agreement: These Terms constitute the entire agreement between you and us
• Waiver: No waiver shall be effective unless in writing
• Assignment: You may not assign these Terms without our consent
